Marriage – Based Green Card (CR1/IR1): Step-by-Step Guide for 2025

If you’re married to a U.S. citizen or lawful permanent resident, you may be eligible for a marriage-based green card – also known as a CR1 or IR1 visa. This visa allows you to live and work permanently in the United States as a legal resident.

Here’s how the process works in 2025, whether you’re applying from inside or outside the U.S.

CR1 vs IR1: What’s the Difference?

  • CR1 (Conditional Resident): Issued if your marriage is less than 2 years old at the time of approval
  • IR1 (Immediate Relative): Issued if you’ve been married for 2 years or more

Both offer permanent residency, but the CR1 requires you to file a removal of conditions (Form I-751) after 2 years.

Step-by-Step Application Process

1. Petition Filing (Form I-130):

The U.S. citizen or green card holder spouse files a petition with USCIS. You’ll need to submit proof of marriage, photos, and joint documents.

2. National Visa Center (NVC) Processing:

Once approved, your case moves to the NVC for fee payments and document uploads.

3. Immigrant Visa Application (DS-260):

You complete this form if applying from outside the U.S. (consular processing).

4. Medical Exam and Interview:

You’ll attend an interview at a U.S. embassy or consulate. Be prepared to prove your relationship is genuine.

Key Documents You’ll Need

  • Marriage certificate
  • Passports
  • Proof of U.S. spouse’s status
  • Proof of relationship (photos, messages, joint bank accounts, etc.)
  • Affidavit of Support (Form I-864)

Processing Time & Costs

  • Timeline: 12–18 months (may vary)
  • Fees: $1,200–$1,760 including USCIS fees, NVC processing, and medical exam

Next Steps After Approval

Once approved, you’ll receive your green card within weeks of entering the U.S. If you received a CR1, apply to remove conditions after 2 years.
